Contents |
The first page of the couple's Marriage Contract contains their names and signatures. They sign their names only after they have both agreed to its contents – and even then the contract does not come into affect.
That happens within an agreed commencement period in the future, which typically begins about 90 days after the contract is agreed and signed, and ends 120 days afterwards.
Contract Title
In the sample below the contract is named Marriage Contract. But it's up to the couple to choose the title they think most appropriate for their contract.
Other examples might include Contract of Love, Covenant of Love, Commitment of Loving Union, Romeo and Juliet's Amazing Life Adventure - whatever.
Whatever title the couple chooses, the contract is usually called the 'Agreement' in the contract itself.
Contract Agreement Date
This is the date when the two partners agree the terms of their Marriage Contract and sign their names to it.
By and Between
This is where each person writes their name – first name, middle name and last name – in block letters. Also, each person enters what is known as their 'short name'. This is the name each will be known as in the remainder of the contract.
The couple need not enter their address or other identifying details. These are recorded in the Exhibit named Declaration of Identity and Residence.
Commencement Period
After the contract has been agreed and signed, a stated time must pass before it can come into effect. In contract law, this is sometimes known as the cooling-off period.
Its purpose is to give both parties the opportunity to reflect fully on what they have agreed before they make the final commitment to proceed with it.
At their wedding ceremony the couple will sign a further document, named the Declaration of Solemnization. This 'brings to life' the contract that have both agreed and signed.
It is unlikely that either person will want to leave the offer of the contract open indefinitely. That is why the Commencement Period also includes a latest end date as well as an earliest start date.
Typically, the Commencement Period extends from 90 to 120 days after the contract has been agreed and signed.
Contract Agreement Signatures
Finally, at near the bottom of the first page, each partner signs his or her name.
Contract Agreement Notarization
Finally, at the bottom of the first page, each person's legal counsel adds their signatures and business stamps.
This records that each person's legal counsel has duly witnessed the couple's signing of the Marriage Contract.
