When drawing up a contract, it's vitally important that close attention is given to the wording. Each clause is intended to provide protection, and must be carefully worded in order for the Contract to hold up in a court of law. In this section of the Marriage Contract the couple set out the agreed and precise meaning of certain words and phrases.
Note: Because this is the first numbered section of the Contract, its two clauses are numbered as 1.1 and 1.2.
1.1 Definitions
This clause typically lists and defines the meaning of words and expressions that are particularly important in a legal contract.
| CONTRACT | means the Agreement concluded between [Romeo] and [Juliet], including its referenced Exhibits. |
| PARTIES | means [Romeo] and [Juliet], the two persons named in the Declarations of Identify and Residence attached in Exhibits A. |
| STATE | means [Ireland]. |
| MARRIAGE | means the legally-binding exchange of rights and obligations between Romeo] and [Juliet] as expressed in this Agreement. For the avoidance of doubt it is stated explicitly that the term marriage does not mean any status the State may create or dissolve, or the State may confer on, or withdraw from, the parties. |
| MARRIAGE CEREMONY | means the signing and witnessing of the Certificate of Solemnization for the purpose of giving effect to the Agreement between [Romeo] and [Juliet]. |
| INDEPENDENT LEGAL COUNSEL | means the provision, prior to the time the Agreement was signed, of legal guidance, advice and comments of any kind to either [Romeo] or [Juliet] by an individual licensed to practice law in the State. For the avoidance of doubt it is stated explicitly that independent in this context means that the same person did not provide counsel to both parties, and that counsel for either party was not financially supported, directly or indirectly, by the other. |
| MARITAL HOME | Means the place or succession of places at which [Romeo] and [Juliet] habitually reside following the execution of the Agreement and for the lifetime of the Agreement. For the avoidance of doubt it is stated explicitly that the term marital home does not mean family home or other expression given to describe any dwelling over which the State has power to determine occupancy or ownership. |
| BUSINESS DAY | Means a day, excluding a Saturday, Sunday or public holiday, on which the commercial banks in the State are generally open for business. |
| MONTH | Means a calendar month, unless otherwise stated. |
1.2 Interpretations
This set of clauses generally deals with words and expressions that are in everyday use and which may possibly be understood in more than one way.
